NFA TRANSFER DISCLOSURE AND ACKNOWLEDGMENT OF RISK

I acknowledge and agree to the following in connection with my transfer of a NFA item without an ATF Form 4 or NFA tax stamp:

  1. Basis for this transfer. This transfer is being conducted under the authority of the permanent injunction issued in Silencer Shop Foundation v. ATF, No. 6:25-CV-056-H (consolidated with Jensen v. ATF, No. 6:26-CV-227), N.D. Tex., San Angelo Division (Dkt. 136, Aug. 5, 2026), as interpreted by War Quail's legal counsel. This is a district court ruling in active litigation, currently unstayed, but not a final, settled change to federal law, the government retains the right to appeal. This injunction runs specifically to the named plaintiffs, their members, and their customers; it is not a nationwide or state-wide exemption.
  2. My representations. I represent that I am either a current member in good standing of Gun Owners of America, Inc. ("GOA") or a customer whose transaction this item traces to Palmetto State Armory, LLC ("PSA"), and that the documentation I have provided is genuine and accurate. I understand that providing false information on this form or the accompanying 4473 is a federal crime.
  3. Risk of reversal. I understand this legal basis may be stayed, narrowed, reversed, or overturned on appeal at any time, potentially after this transfer occurs. If that happens, I understand this item may become subject to retroactive NFA registration requirements (including possible Form 1 registration and/or the $200 making/transfer tax then in effect), and that compliance with any such requirement becomes my sole legal responsibility as the owner.
  4. No guarantee. War Quail LLC makes no guarantee regarding the ultimate legal status of this transfer or this item, and are relying in good faith on written counsel guidance current as of the date of this transfer.
  5. Release. I release War Quail, its owner and staff, from liability arising from changes in the legal status of this transfer after the fact, to the extent permitted by law.
  6. My own counsel. I have been advised to consult my own attorney if I have questions about this transfer before signing.
